Los Angeles DA Gascon’s New Policy Instructs Prosecutors to Provide Illegal Immigrants with Relatively Softer Treatment

Los Angeles District Attorney George Gascon has instructed prosecutors to provide illegal immigrants with an advantage over U.S. citizens, according to a report on Fox News. The new policy requires DAs to consider the consequences that criminal charges will have on suspects and attempt to find diversion programs to prevent their deportations.

The initiative is unambiguous about its objectives: to keep illegal immigrants out of prison and safe from deportation, even if they've harmed Americans. “All charging determinations shall be undertaken with the goal of avoiding or mitigating the adverse immigration consequences of a decision when known, possible or permitting,” the policy states. “Under these circumstances and when, consistent with public safety alternatives to filing charges exist, those alternatives shall be pursued.”

Criminal enhancement charges must be avoided as well, in accordance with the directive. These charges could include measures such as gang enhancement, great bodily injury enhancement, or gun enhancement. These charges can result in harsher punishments. “According to the policy, which was obtained by Fox News, alternatives to criminal convictions should be considered, such as avoiding charging for criminal enhancements, which can significantly increase one’s prison sentence, ‘that would turn an otherwise immigration-neutral offense into an immigration damaging one.’”

This latest wake-up call from Gascon is a clear indication of his preference for illegals, or, in other words, the policy is discrimination in plain language against legal citizens.

The new marching orders, like almost all of Gascon's extreme declarations, won't improve the safety on our streets; in fact, they'll increase the risk of becoming a victim. RedState’s managing editor, Jennifer Van Laar, brought the tragic story of Drew Rosenberg, who was killed in 2010 by Roberto Galo, an illegal previously charged with a criminal offense who was given lenient treatment under the policies of former San Francisco DA Kamala Harris and then-San Francisco Mayor Gavin Newsom. His father blamed Drew's murder directly on their soft-on crime policies: “Rosenberg believes his son’s blood is on the hands of Kamala Harris and then-Mayor Gavin Newsom because it was their pro-illegal alien policies that allowed Galo to remain in the country, to remain on the streets, and to have access to the vehicle with which he ran down Drew Rosenberg.”

Despite previous convictions for vehicle crimes, Galo eventually served only 45 days in prison for the death of Rosenberg. How could this have happened? [Harris and Newsom] “(who owe their political lives to notoriously shady former San Fran Mayor Willie Brown) are at fault because, Rosenberg contends, Newsom instituted a ‘policy’ in September 2009 to not impound the vehicles of illegal aliens arrested for driving without a license, and Harris’s office had a similar policy, to not prosecute unlicensed drivers unless they had been in a fatal collision, both of which benefited Roberto Galo.”

Gascon held the position of San Francisco District Attorney at the time that Galo's trial took place. He has been hoping to bring more of the San Francisco style of justice to Los Angeles. His office issued one of their word-salad statements highlighting how wonderful the policy is and the way they will “prioritize” safety. It is important to note that they do not provide a specific way to be able to achieve this goal. “The Los Angeles District Attorney's Office consulted with our staff, community stakeholders and immigration experts to craft a comprehensive Immigration policy that protects vulnerable victims and prioritizes safety while attempting to avoid overly punitive consequences for the accused,” Tiffany Blackwell, communications director of the office of the DA, stated in an interview with Fox News Digital. “We believe that we have achieved that result.”

Gascon has been a one-man wrecking crew in the City of Angels, and his deference towards criminals has resulted in regular reports of random attacks and smash-and-grab robberies, as well as a general feeling of fear in the streets of the city. Unfortunately, two recall attempts against him failed, and he has been left free to implement this new and frightful policy. Again, he's made the streets more dangerous.
